Terms of use

A nonexclusive limited license is granted to user (customer who purchases products sold on our website, hereinafter referred to as “user”)  based on the following terms and conditions:

Membership

The following membership categories specify the number of websites (Wordpress! Installations, not domains, hereinafter referred to as “websites”) on which user is allowed to use DaThemes templates.  Use of DaThemes templates or other products on more than the allowed number of websites is strictly prohibited.  Current user must remove DaThemes templates from any existing websites that don't comply with terms of use.  Registration of all websites using DaThemes templates is required.  This is done on the “site list” in user member area.  There is no time limit on using registered templates.  Once registered, the selected templates belong to user and can be used forever, even if user membership is expired.

Silver membership

Silver membership grants member the right to use any existing DaThemes  template or other product on one website. Once the 3-month subscription expires, the user will lose ability to download new themes. 

Gold membership

Gold membership grants member the right to use any existing DaThemes  template or other product on up to three websites.  Once the 12-month subscription expires, the user will lose ability to download new themes. 

Platinum membership

Platinum membership grants member the right to use any existing DaThemes  template or other product on an unlimited number of websites. After 12 month subscription expiration the user will not be able to download new themes unless the subscription is renewed.

Product Delivery

DaThemes will email membership information within 24 hours of receipt of payment, allowing user immediate access to member area.  User must provide a valid email address. User will also be contacted via the email address provided.  Occasionally Paypal will perform a manual fraud check which can delay receipt of payment. 

Refund Policy

Refund requests must be made by email and must accurately describe the situation, the issue, and the reason for the refund request.  Since Dathemes software is non-tangible and irrevocable, every effort will be made to resolve the issue before a refund is provided.

Privacy Policy

User information will only be used for transaction processing, product delivery, providing information about product updates and resolving customer issues.

License

Ownership

All DaThemes products are the property of DaThemes.  Even if user modifies DaThemes products they are not owned by user.

Demo web content is solely for demonstration purposes.  It is strictly prohibited to re-use any images, graphics, icons, or other content from the demo website.

Unauthorized use

User cannot copy DaThemes products, modified or unmodified, onto disks, websites, P2P or other medium for resale purposes without prior written agreement with DaThemes.

Modifications

User can modify DaThemes templates and other products as required including all php, javascript, html and css files as well as the xml descriptor file.  However, the copyright information must remain in the source code in its original form and 3rd party libraries cannot be modified.  Visual copyrights can be removed.  User is not permitted to redistribute these modifications as GPL or other licenses.

Assignability

DaThemes licensing can be assigned to another user only with a prior written agreement between user and DaThemes.

Warranty

DaThemes guarantees that our products work with the current version of Wordpress!  However, there is no guarantee that DaThemes products will work with future or outdated versions of Wordpress!, third party components, or other browsers.  DaThemes provides no other warranty or guarantee for our products.

Support

Product support is handled solely through the user forum,which is not monitored by DaThemes.  No email support will be provided for installation, modification or administration of any DaThemes products.

Terms may be changed or modified at any time at the sole discretion of DaThemes without prior notice.  User is advised to review changes to our privacy policy each time user goes to this website.
